Richard Lionberger, Attorney (or the Firm) operates the www.rll-law.com website (hereinafter referred to as the Service).

This page informs you of the policies regarding the collection, use and disclosure of personal data when you use the Service and the choices you have associated with that data.

The Firm uses your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

Definitions

Service

Service is the www.rll-law.com website operated by Richard Lionberger, Attorney.

Data Processor (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller.

The Firm may use the services of various Service Providers in order to process your data more effectively.

Data Subject is any living individual who is using the Service and is the subject of Personal Data.

The Firm collects several different types of information for various purposes to provide and improve the Service for you.

Types of Data Collected

Personal Data

While using the Service, the Firm may give you the option to provide certain personally identifiable information that can be used to contact or identify you (Personal Data). Personally identifiable information may include, but is not limited to:

  • First name and last name
  • Phone number
  • Cookies and Usage Data

The Firm may use your Personal Data to respond to your inquiries and provide legal services. The Firm will not use contact form submissions to send unsolicited marketing or promotional communications.

Usage Data

The Firm may also collect information on how the Service is accessed and used Usage Data. This Usage Data may include information such as your Internet Protocol address (e.g. IP address), browser type, browser version, the pages of the Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Tracking Cookies Data

The Firm uses cookies and similar tracking technologies to track the activity on the Service and holds certain information.

Cookies that are strictly necessary for the operation of the Service are placed without prior consent. Non-essential cookies (including analytics cookies) are placed only after you have given your consent via the cookie preference mechanism presented upon your first visit to the Service. Users may accept or decline non-essential cookies through that mechanism.

Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. The Firm uses the collected data for various purposes:

  • To provide and maintain the Service
  • To notify you about changes to the Service
  • To respond to contact form inquiries and provide legal services
  • To gather aggregate information to improve the Service
  • To monitor the usage of the Service
  • To detect, prevent and address technical issues

Legal Basis for Processing Personal Data under the General Data Protection Regulation (GDPR)

If you are from the European Economic Area (EEA) or the United Kingdom (UK), the Firm’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data collected and the specific context in which the Firm collects it.

The applicable legal basis for each category of processing is set out below:

  • Contact form submissions: Article 6(1)(b) GDPR — processing necessary for the performance of steps taken at the data subject’s request prior to entering into a contract (i.e., responding to a prospective client’s inquiry). For EEA and UK residents, the Firm also relies on Article 49(1)(b) GDPR as the basis for any associated transfer of data to the United States, as such transfer is necessary to respond to the inquiry at the data subject’s request.
  • Website analytics via StatCounter: Article 6(1)(f) GDPR — legitimate interests in understanding aggregate website traffic patterns to improve the Service. The data collected by StatCounter does not identify individual visitors.
  • Website hosting and technical operation via The Modern Firm: Article 6(1)(b) GDPR — necessary for the operation of the Service.
  • To comply with the law: Article 6(1)(c) GDPR — legal obligation.

Retention of Data

The Firm will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. The Firm will retain and use your Personal Data to the extent necessary to comply with legal obligations (for example, if the Firm is required to retain your data to comply with applicable laws), resolve disputes and enforce legal agreements and policies.

The Firm will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of the Service, or the Firm is legally obligated to retain this data for longer periods.

Aggregate analytics data collected through StatCounter is retained in accordance with StatCounter’s data retention policies.

Transfer of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

The Service is hosted by The Modern Firm, LLC, a U.S.-based company. Contact form submissions and related personal data are processed on servers in the United States. If you are an EEA or UK resident who submits a contact inquiry, the transfer of your personal data to the United States is made on the basis of Article 49(1)(b) GDPR — the transfer is necessary to take steps at your request prior to the Firm responding to your inquiry. StatCounter, which provides website analytics, is headquartered in Dublin, Ireland, and processes analytics data within the European Union; no transfer to the United States occurs in connection with analytics.

The Firm will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

Disclosure of Data

Legal Requirements

The Firm may disclose your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Firm
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of users of the Service or the public
  • Protect against legal liability

Security of Data

The security of your data is important to the Firm but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While the Firm strives to use commercially acceptable means to protect your Personal Data, the Firm cannot guarantee its absolute security.

Do Not Track and Global Privacy Control Signals

The Firm does not currently respond to browser-level Do Not Track DNT signals. However, the Firm recognizes Global Privacy Control (“GPC”) signals as valid opt-out requests where required by applicable law. GPC is a browser-based signal that communicates a user’s preference to opt out of the sale or sharing of personal data. The Firm does not sell personal data.

You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Your Data Protection Rights under the GDPR and UK GDPR

If you are a resident of the European Economic Area (EEA) or the United Kingdom, you have certain data protection rights. The Firm aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Data.

If you wish to be informed about what Personal Data the Firm holds about you and if you want it to be removed from the systems, please contact the Firm.

In certain circumstances, you have the following data protection rights:

  • The right to access, update or delete the information the Firm has on you. Whenever made possible, you can access, update or request deletion of your Personal Data by contacting the Firm directly.
  • The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
  • The right to object. You have the right to object to the processing of your Personal Data.
  • The right of restriction. You have the right to request that the Firm restricts the processing of your personal information.
  • The right to data portability. You have the right to be provided with a copy of the information the Firm has on you in a structured, machine-readable and commonly used format.
  • The right to withdraw consent. You also have the right to withdraw your consent at any time where the Firm relied on your consent to process your personal information.

Please note that the Firm may ask you to verify your identity before responding to such requests.

You have the right to lodge a complaint with a supervisory authority regarding the Firm’s collection and use of your Personal Data. If you are located in the European Economic Area (EEA), please contact your local Data Protection Authority. If you are located in the United Kingdom, you may contact the Information Commissioner’s Office (ICO) at ico.org.uk.

The Firm has not designated an EU or UK representative under Article 27 GDPR or its UK equivalent, as the Firm’s processing of personal data from EEA and UK residents is occasional and does not involve large-scale processing of special categories of data.

Service Providers

The Firm employs the following third-party companies to facilitate or support the Service. These third parties have access to your Personal Data only to perform tasks on the Firm’s behalf and are obligated not to disclose or use it for any other purpose.

Website Hosting — The Modern Firm, LLC

The Modern Firm, LLC (Ann Arbor, Michigan) provides website design, hosting, and technical support for the Service. As the hosting provider, The Modern Firm processes data transmitted through the Service, including contact form submissions, on the Firm’s behalf. For more information, visit:

Analytics — StatCounter

StatCounter (Dublin, Ireland) is a web analytics service that provides aggregate statistics about visitors to the Service. StatCounter collects visit data including IP address, browser type, pages visited, time of visit, and referring URL for the purpose of generating traffic statistics. This data is used in aggregate form only and does not identify individual visitors. StatCounter is headquartered in the European Union and processes analytics data within the EU; no transfer to the United States occurs in connection with this service.

Tag Management — Google Tag Manager

The Service uses Google Tag Manager, a tool provided by Google LLC (Mountain View, California) that allows the Firm to manage website tags without modifying code directly. Google Tag Manager itself does not collect personal data but may load other scripts or tags on the Service. The Firm uses Google Tag Manager solely to manage the StatCounter analytics tag. The Service may contain links to other sites that are not operated by the Firm. If you click a third party link, you will be directed to that third party’s site. You are strongly advised to review the Privacy Policy of every site you visit.

The Firm has no control over and assumes no responsibility for the content, privacy policies or practices of any third party sites or services.

Children’s Privacy

The Service does not address anyone under the age of 18 (“Children”).

The Firm does not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided the Firm with Personal Data, please contact the Firm. If the Firm becomes aware that it has collected Personal Data from children without verification of parental consent, steps will be taken to remove that information from the Firm’s servers.

Changes to This Privacy Policy

The Firm may update this Privacy Policy from time to time. The revised Privacy Policy will be posted on this page with an updated revision date.

The Firm will let you know via email and/or a prominent notice on the Service, prior to the change becoming effective, and update the date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
